Affiliate Terms & Conditions
By applying to join the Boosey & Hawkes Affiliate scheme you agree to these Terms & Conditions. Throughout these terms and conditions:
- "the Affiliate" refers to you
- "B&H" refers to Boosey & Hawkes Music Publishers Ltd
- "the Affiliate site" refers to the website controlled by you from which you link to the B&H website
- "the B&H site" refers to the website owned and controlled by B&H and located at www.boosey.com or other such URL as may be specified by B&H from time to time
The Affiliate scheme allows Affiliates to earn commission on sales of sheet music, song books and scores sold through the B&H site. It does not include sales of CDs and other merchandise.
1. The application process
Applicants wishing to join the Affiliate scheme must complete and submit the Affiliate Application form on the B&H site. B&H shall in its absolute discretion decide whether to accept or reject the application. Successful applicants will be sent an Affiliate ID by email.
2. Links from Affiliate site to the B&H site
The Affiliate may use any of the links and code modules hosted in the Affiliate section of the B&H site to provide links from the Affiliate site to the B&H site. The Affiliate may choose how many links to use and the locations within its site where the links will be placed.
Users who click on the links on the Affiliate site and arrive at the B&H site will be tracked via a cookie in their browser. For any purchases on the B&H site made by such visitor on that visit or on any subsequent visits during the following 30 days, B&H will either provide a discount and/or will pay commission to the Affiliate as described in Clause X below.
3. Affiliate rewards
B&H will pay out the Affiliates Rewards percentage of the purchase price (excluding postage and packing charges) that is applicable at the time of the sale. The applicable Affiliates Rewards percentage is published on the Affiliates section of the website (www.boosey.com/shop/affiliates). The rewards can be made available as discounts to the Affiliate's users who are making the purchases or as commission payable to the Affiliate or as a combination of both. On application the Affiliate will be asked to specify the split between discounts and commission. The Affiliate can alter the split at any time by logging onto their Affiliate home page on the B&H site.
Commission is payable only on money received, net of any returns or cancellations. Customers are charged at the time of despatch not at the time of order.
4. Exclusions
Affiliate rewards will not be payable on any items which are already subject to a discount or other promotional offer.
The Affiliate acknowledges that B&H is unable to track users who have disabled the cookies in their browser and that it is therefore unable to pay out Affiliate rewards on any purchasers made by such users.
The Affiliate acknowledges that if a user is already being tracked as belonging to another Affiliate, the prior Affiliate will receive the Affiliate rewards.
5. Payment
Commission payments to Affiliates will be made quarterly, subject to a minimum threshold of £25.00. If the commission payable is less than £25.00 it will be added to the following quarter's commission until the total reaches £25.00 at which point an invoice will be emailed to the Affiliate and payment will be made to the bank account specified by the Affiliate in the application process.
6. Customers
Customers who make purchases under the terms of this Affiliate scheme will be treated as customers of B&H and will be subject to the privacy policy and other terms and conditions published on the B&H site at the time of purchase. B&H will not pass customer data to the Affiliate.
7. The Affiliate site
B&H is not responsible in any way for the content or functioning of the Affiliate site and specifically disclaims any liability for any illegal content or any content that infringes the right of third parties appearing on the Affiliate site.
8. Term of the agreement
This agreement commences on the date that B&H issues an Affiliate ID to the Affiliate. Either party may terminate this agreement at any time by giving the other party written notice. Final payment of commission outstanding will be made 30 days after the end of the agreement to allow time for returns or cancellations to be accounted for.
9. Changes to the terms and conditions
B&H may from time to time make changes to these terms and conditions. Affiliates will be notified by email and a revised copy of the terms and conditions will be made available on the B&H site. If any Affiliate does not wish to accept the changed terms and conditions it may terminate the agreement. Failure to terminate the agreement will indicate that that the Affiliate accepts the changed terms.
10.Disclaimers
B&H makes no express or implied warranties or representations with respect to the Affiliate scheme or the products sold through it. B&H also does not guarantee that the B&H site will be operational or error-free at all times.
11. No partnership
Nothing in this agreement will create or be deemed to create any partnership, joint venture, agency, franchise, sales representative or employment relationship between B&H and the Affiliate. The Affiliate will not have any authority to act or communicate on behalf of B&H and will not represent itself as having such authority.
12. Governing law
This agreement is governed by the laws of England and Wales. Any dispute pertaining to this agreement must be dealt with by the courts of England and the Affiliate irrevocably consents to the jurisdiction of such courts.
